UAE Notice Period Rules 2026: Employment, Rental, and Commercial
Notice periods in the UAE are different for employment, residential tenancy, and commercial leases — and getting them wrong can cost you money, your visa, or even your business. This guide covers every notice period rule you need to know, from resignation to rental non-renewal to commercial lease exit.
Employment Notice Periods
Under Federal Decree-Law No. 33 of 2021, the employment notice period in the UAE must be between 30 and 90 calendar days, and it must be the same for both employer and employee. If your contract requires you to give 60 days' notice, your employer must also give you 60 days.
During the probation period (maximum 6 months), either party can terminate with 14 days' written notice. If the employee plans to leave the UAE entirely during probation, the 14-day notice applies. If the employee wants to join another employer within the UAE during probation, they must give 30 days' notice or one month's notice — whichever is specified in the contract.
The notice period starts from the day the written notice is delivered, not from the day it is drafted or sent. Use email with a read receipt, hand-delivery with an acknowledgment signature, or registered mail to ensure you can prove the delivery date.
Payment in Lieu of Notice
Either party can opt to pay compensation instead of serving the notice period. If you resign and your employer wants you to leave immediately, they must pay you for the full notice period. If you resign and want to leave immediately, you must pay your employer the equivalent of the notice period salary.
The payment is calculated based on the last salary received, including basic salary and regular allowances. It does not include irregular payments like annual bonuses or commissions. If you have served part of the notice period, the payment covers only the remaining days.
Working During Your Notice Period
You are required to continue performing your duties during the notice period unless both parties agree otherwise. Your employer can place you on "garden leave" — paid leave where you do not need to come to work but are still technically employed and bound by your contract terms, including confidentiality and non-compete obligations.
Under the new labour law, an employee who resigns is entitled to one unpaid day per week during the notice period to search for a new job. This must be a full day and the employee must notify the employer at least three days in advance of the day they intend to take. This right cannot be waived by contract.
Residential Rental Notice Periods
For residential tenancies in Dubai, the key notice periods are:
Non-renewal by either party
90 days' written notice before lease expiry. If the landlord wants to change any terms (including rent), they must notify you at least 90 days before the contract expires.
Eviction for personal use
12 months' written notice via notary public or registered mail. The landlord must prove they or a first-degree relative intend to occupy the property.
Eviction for demolition or major renovation
12 months' written notice. The landlord must provide evidence from the relevant authority that the property requires demolition or renovation that cannot be done while occupied.
Eviction for sale
12 months' notice. However, tenants have priority to remain until the end of their current lease, even after the property is sold. The new owner inherits the existing tenancy contract.
Commercial Lease Notice Periods
Commercial lease notice periods are almost entirely governed by the contract terms. There is no standard statutory notice period for commercial non-renewal in the way there is for residential tenancies. Your contract might require 30, 60, 90, or 180 days' notice.
If your commercial lease does not specify a notice period for non-renewal, the default under general contract law is "reasonable notice," which courts typically interpret as 90 days. However, relying on this default is risky — always ensure the notice period is explicitly stated in your lease.
Abu Dhabi and Other Emirates
Employment notice periods are governed by federal law and are the same across all emirates. Rental notice periods, however, vary. In Abu Dhabi, the tenancy law (Law No. 20 of 2006) requires different notice periods than Dubai. Landlords must provide two months' notice for non-renewal, and tenants must also give two months' notice.
In Sharjah, Ajman, and the northern emirates, notice periods may differ further. Always check the specific tenancy regulations for the emirate where your property is located. Do not assume that Dubai rules apply elsewhere.
How to Serve Notice Correctly
Employment: Submit written notice to HR or your direct manager via email with read receipt. Keep a copy. The date of delivery is the start of the notice period.
Rental non-renewal: Send written notice to your landlord or agent via email and registered mail. State the Ejari number, contract end date, and your intention to vacate.
Commercial lease: Follow the exact notice method specified in your contract — many require registered mail to a specific address. Other methods may not be valid.
Common Notice Period Mistakes
Counting working days instead of calendar days: All UAE notice periods are calendar days. Weekends and holidays count.
Verbal notice: Verbal resignation or rental non-renewal is not legally sufficient. Always provide written notice and keep proof of delivery.
