Employment Contract Red Flags in the UAE: What to Check Before You Sign

Moving to the UAE for work is exciting. Signing an employment contract should not be the part where things go wrong. After analysing hundreds of employment contracts, these are the clauses that employees most often regret not reading.

Non-Compete Clauses That Block Your Entire Career

UAE Federal Decree-Law No. 33 of 2021 permits non-compete clauses of up to two years. Some employers use this to the maximum, restricting you from working for any competitor across the entire UAE or even the GCC region.

Combined with the requirement to have employer sponsorship for your visa, a broad non-compete effectively forces you to leave the country if you want to work in your field after resigning.

What to check: Geographic scope (UAE vs GCC-wide), duration (6 months is reasonable, 24 months is extreme), and whether it covers your specific role or your entire industry.

Garden Leave at Reduced Pay

A growing number of UAE contracts include garden leave provisions where you serve out your notice period at home, often at a reduced salary of 50 to 75 percent. During garden leave, your non-compete has not yet started, you cannot work elsewhere, and your gratuity calculation may be affected by the reduced salary during this period.

Intellectual Property Assignment Beyond Your Job

Standard IP clauses assign work product created during employment to the employer. Aggressive IP clauses assign anything you create, including personal projects, side businesses, and open-source contributions, if they relate to the employer's business in any way. Given the broad definitions most contracts use, this could capture almost anything you build.

Probation Period Termination Rights

During the probation period (up to six months under UAE law), the employer can terminate without reason by giving 14 days notice. But some contracts waive the notice requirement entirely, allowing same-day termination during probation with no severance and no return ticket. If you have relocated to the UAE with your family, this clause puts you in an extremely vulnerable position.

End-of-Service Gratuity Calculation

UAE law guarantees gratuity after one year of service. Some contracts reference "basic salary" for gratuity calculation while your offer letter references "total package." The difference between basic salary (which might be 60 percent of your package) and total compensation can be tens of thousands of dirhams over a multi-year tenure.

Relocation and Repatriation Terms

Many contracts promise a relocation allowance and a return flight at the end of employment. But the conditions for receiving these benefits are often restrictive. Some require a minimum tenure of two years before the return flight is covered. Others deduct the relocation allowance pro-rata if you leave before a specified period. These conditions are usually in the fine print of an annexure, not the main contract.
